Petitioners have filed this writ petition seeking following reliefs: 10.1 That, this Hon’ble Court may kindly be pleased to issue a writ, order, or direction in the nature of mandamus, directing the respondents authority to grant/provide the benefit of the Revised Pay Scale to the petitioners after completion of 3 years of service, as per the policy and in view of the affidavit submitted by the Respondent State Authority in W.A. No. 481/2015. 10.2 That, this Hon’ble Court may kindly be pleased to direct the Respondents Authority to calculate and pay the entire arrears of salary and other consequential benefits (including Dearness Allowance) arising from the revision of pay scale, from the date of entitlement to the date of actual payment. 3 10.3 That, this Hon’ble Court may kindly be pleased to issue direct the Respondent Authority to pay interest at the rate of 12% per annum on the total amount of arrears due to the petitioners, calculated from the date they became eligible until the date of actual realization. 10.4 That, this Hon’ble Court may kindly be pleased to pass any appropriate orders/directions in favour of the petitioners looking to the facts and circumstances fo the case. 2. Learned counsel for the petitioner submits that the petitioners were appointed as Class-IV employee, i.e., peon (cook, waterman and watchman respectively) by the appointment order dated 24.07.2013 and 16.12.2013 (Annexure P/1 Colly). He submits that pursuant to the order passed by High Court in W.A. No. 481/2015 (Prakash Dansena & Ors. Vs. State of Chhattisgarh & Ors.) dated 03.10.2018, the respondent authorities have granted time bound pay scale to the similarly situated employees vide order dated 20.09.2021 w.e.f. 2016. Though the petitioners are getting revised pay in view of the order dated 20.09.2021, but the petitioners are not being paid arrears of pay from the dae of entitlement till the date of granting revised pay. Petitioners have submitted representations raising their grievance for payment of arrears of revised pay scale before the respondent authorities. However, the same is pending consideration and therefore, 4 direction be issued to the respondent no. 5 to consider and take decision on the representations submitted by the petitioners. 3. On the other hand, learned counsel for the respondent/State would submit that as petitioners are not pressing this writ petition on merits and is only seeking a direction to the respondent no. 5 to consider and take decision on the representations submitted by the petitioners, he is having no objection to the limited prayer. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, without entering into the merits of the claim of petitioners this writ petition at this stage is disposed of directing the respondent no. 5 to consider and take decision on the representations submitted by the petitioners in accordance with law, expeditiously, preferably within a period of 4 months from the date of receipt of representation. 6.
