In Re: An application for cancellation of bail under Section 439(2) of the Code of Criminal Procedure, 1973 filed in connection with Asansol (South) Police Station Case No.150 of 2020 dated 19.05.2020 under Sections 341/323/379/506/34 of the Indian Penal Code read with Section 3 of the Scheduled Caste and Scheduled Tribe Act (Prevention of Atrocities) Act, 1989;
Deb Kumar Ravidas Versus The State of West Bengal & Ors.
Mr. Sourav Saha. …for the petitioner.
Ms. Shaila Afreen Ms. Debadrita Mondal. …for the State.
Learned advocate for the petitioner submits that charges have already been framed and the trial would progress.
Records reflect that there were suppressions at the behest of the accused persons for obtaining bail from the court of the learned CJM, Paschim Bardhaman.
Learned advocate for the State is present.
Having considered that bail was granted on 26.06.2020, more than 5 years 9 months ago, at this belated stage, I am not inclined to interfere with the order of bail as there are no materials before this Court in respect to post bail conduct.
Report submitted by the State reflects that trial is in progress and there are no violations relating to post bail conduct.
Having regard to overall circumstances, at this stage, the
2 application being CRM 5869 of 2020 along with CRAN 4287 of 2020 is dismissed.
Report submitted by the State be kept with the record.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
