JUSTICE AHANTHEM BIMOL SINGH (ORDER) (Order of the Court was made by the Hon’ble Chief Justice) 31-07-2026 [1] Captioned Miscellaneous Case (MC) has been filed with a prayer to dispense with/exempt MC applicants from filing certified copy of the order dated 26-06-2026 made in Judl. Misc. (Execution) Case No. 41 of 2026 in Execution Case No. 1 of 2023 on the file of the Court of District Judge, Imphal West (Commercial Court). This 26-06-2026 (wrongly mentioned as ‘30th May 2026’ in MC application for which the State Counsel, Ms. N. [2] Ms. N. Jyotsana Devi, learned State Counsel who is before this Court, adverting to MC application, submits that the impugned order has been filed in MAF No. 1 of 2026 which was withdrawn (withdrawn on 29-07- 2026) with liberty to file a appeal afresh as it was filed under wrong provision of law. [3] MC applicants, vide paragraph No. 6 of MC application, have undertaken to file certified copy of impugned order no sooner than the same is made available to the applicants. Registry is directed to return the certified copy of impugned order filed in MAF No. 1 of 2026 to State Counsel on record under due acknowledgement forthwith. Be that as it may, MC applicants have in any event filed a photocopy of certified copy of impugned order which has also been authenticated by a Commissioner of Affidavit, High Court of Manipur. [4] Prayer in captioned MC is innocuous and is a matter between Court and the MC applicants. Therefore, notice to sole respondent is dispensed with and captioned MC is ordered as prayed for/allowed.
