Heard learned counsel for the petitioner who submitted that by this petition, the petitioner has challenged the order of invalidation passed by the respondent No.1-the District Caste Certificate Scrutiny Committee, Yavatmal invalidating the caste claim of the present petitioner by order dated 06.08.2026. The petitioner claims to be of “Mathura Labhan” which belongs to the VJ-A category. The petitioner has already obtained caste certificate “Mathura Labhan” on 19.06.2025. The caste claim of the petitioner was forwarded on 16.01.2026 and the relevant documents. Now the petitioner has already appeared in CAP Round III in the seat reserved for Vimukta Jati-A Category for admission in B.Tech. Now the petitioner is already admitted in Dr. D.Y. Patil College of Engineering & Innovation, Pune in the stream of B.Tech but there is an apprehension of cancellation of admission for want of validity certificate. If the petitioner is not protected, then there is an apprehension of loosing the opportunity of his further education. In view of that, she prayed for protection to the present petitioner. 2. Learned AGP and learned counsel for the respondent No.2 strongly opposed the said contention and submitted that the Committee has already invalidated caste claim of the present petitioner and therefore, the petitioner is not entitled for any relief from this Court. 3. On hearing both the sides and on perusal of the record it reveals that the petitioner claims to be of “Mathura 3 18 wp 6442.26.odt..odt Labhan”. It is the contention of the learned counsel for the parties that despite there are various documents placed on record the Committee has invalidated the caste claim of the petitioner. Admittedly, the time is required to decide the petition of the present petitioner as considering the petitioner is now already admitted in the college of Engineering i.e.Dr. D.Y. Patil College of Engineering & Innovation, Pune. However, there is an apprehension of loosing the opportunity of further education for want of validity certificate. Now the State Government has already issued the Government notification on 04.09.2026 extending the time limit for production of validity certificate by three months. Therefore, we are of the considered opinion that such type of the benefit can be extended to the present petitioner also. 4. In view of that, we proceed to pass following order:- (i) Respondent Nos.2 and 3 shall not cancel the admission of the present petitioner for want of validity certificate if he is otherwise eligible. (ii) Admission of the present petitioner would be subject to final outcome of this petition. (iii) Petitioner shall not seek any equity on this ground. 5. Issue notice to the newly added respondent No.3. 4 18 wp 6442.26.odt..odt 6. Petitioner is permitted to serve respondent No.3 by all modes of service and shall file affidavit of service on record. 7.
