Dubey, AC to AG For the NHAI : Mrs. Sweety Topno, Advocate …...... 02/ 21.04.2026 In this Writ petition, the petitioners have prayed for direction upon the District Land Acquisition Officer, Chatra-Cum-Competent Authority to refer the matter in relation to payment of compensation under Section 3(H)(4) to the Court of Principal Civil Judge, Chatra under the Provisions of National Highways Act, 1956. 2. It is submitted by petitioners that the District Land Acquisition Officer, Chatra is not referring the dispute before the Principal Civil Judge, Chatra under the provisions of National Highways Act, 1956. 3. Mr. Mohan Kr. Dubey appears on behalf of the State submits that the matter is still pending and appropriate instruction will be given to the competent authority to act in terms of National Highways Act, 1956 and refer the dispute to the Principal Civil Judge, Chatra. 4. Considering the aforesaid submissions, this application is disposed of with the direction to the respondents to consider the case of the petitioners and refer the matter to the Principal Civil Judge, Chatra where the grievance of the petitioner can be redressed in terms of National Highways Act, 1956.
