Munir, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for granting pre-arrest bail to the petitioner, Md Mostufa Hussain @ Mostu in respect of Page No.# 2/2 Samaguri P.S. Case No.129/2026, under Sections 303(2)/317(2)/317(4) of the BNS, 2023. 3. Police got information on 10.05.2026 that the petitioner has been keeping stolen cows in his house. Police went to the house of the petitioner and seized the cows. Therefore, Police registered the case under Sections 303(2)/317(2)/317(4) of the BNS, 2023. 4. I have considered the submissions made by the learned counsel for both sides. 5. The cows are already seized by the Police and therefore, the petitioner does not deserve to be detained in custody. Therefore, his application is allowed. 6. It is hereby directed that in the event of arrest in connection with Samaguri P.S. Case No.129/2026 the petitioner, Md Mostufa Hussain @ Mostu shall be released on fresh bail of Rs.25,000/- with a surety of like amount to the satisfaction of the arresting authority. 7. The petitioner shall co-operate with the Police Investigating Officer as and when called for. 8. With the aforesaid direction, this pre-arrest bail application stands disposed of.
