As can be seen from record and as has been submitted by learned Counsel for the applicant that applicant wife has already filed petition under Section 9 of the Hindu Marriage Act, seeking restitution of conjugal rights. In addition to this, criminal prosecution for offence punishable under Section 352, 351(2), 115(2) and 85 of the BNS is also pending at Amravati. 2. On 28.08.2026, nobody appeared for non- applicant and therefore the matter was kept for today. 3. Today also, nobody turns up for non-applicant. (2) 28 mca 292-2026 4.
