P.P. …...... 03/ 24.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as they are in custody for allegedly committing offence punishable under Sections 74, 76, 117(2), 126(2), 109(1), 3(5) of the Bharatiya Nyaya Sanhita and under Section 8 of POCSO Act. 2. Heard, learned counsel for the petitioners, learned counsel for the State and have also gone through the impugned order. 3. Learned A.P.P. opposes the prayer for bail. 4. The allegation in the FIR is that the son of one of the petitioner with others was molesting the daughter of the informant. The informant thereafter went to the house of the petitioner to question the attitude and act of his son. Thereafter, it is alleged that these petitioners and other assaulted the informant. 5. Admittedly, so far as the allegation of molesting is concerned, it is upon the son of the informant. The only allegation against these petitioners is that of assaulting. Though one of the injuries is grievous, but the fact remains that there is no specific allegation against these petitioners and the allegations are general and omnibus in nature. 6. Considering the aforesaid fact and the fact that petitioners are in custody since 19.09.2025 and chargesheet has already been submitted, I am inclined to grant bail to these petitioners. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge POCSO, Latehar in connection with Barwadih Police Station Case No.58 of 2025 subject to the condition that one of the bailors should be a close relative of the petitioners, having sufficient landed property in his own name within the State of Jharkhand.
