Learned counsel for the petitioner prays for the following reliefs: 10.1 That, this Hon’ble Court may kindly be pleased to call for the entire records in relates to the case of the petitioners from the possession of respondents for its kind perusal. 10.2 That, this Hon’ble Court may kindly be direct the respondent no. 1 to take a final decision upon the proposal sent by the respondent no. 2 regarding for the absorption of 3 the Teacher (L.B.) Librarian to the post of Teacher (L.B.) (Label-8 post) on 11.02.2022 (Annexure P/1) within a period of 15 days. 10.3 That, this Hon’ble Court may kindly further be pleased to direct the respondents to consider and decide the pending representations (Annexure P/8) of the petitioners regarding for the one time absorption on the post of Teacher (L.B.) (Label-8 post) to the post of Teacher (L.B.) Librarian within a stipulated period of 15 days. 10.4 That, this Hon’ble Court may kindly be pleased to grant any other relief/s in favour of the petitioners, which the Hon’ble Court deemed fit and just in the facts and circumstances of the case, including awarding of the costs to the petitioners. 2. Learned counsel for the petitioners submits that the petitioners were initially appointed on the post of Shikshakarmi Grade III. After completion of the proposed period they were confirmed in service. In the year 2012, new rules have been brought in the name of C.G. Teachers (Panchayat) Cadre (Recruitment and Conditions of service) Rules 2012 and the designation of Shiksha Karmi Grade III, Shiksha Karmi Grade II and Shiksha Karmi Grade I is redesignated as Assistant Teacher, Teacher and 4 Lecturer respectively. 3. Petitioners were specifically promoted to the post of Teacher (Panchayat) Librarian from the post of Assistant Teacher (Panchayat). Petitioners were observed in the School Education Department pursuant to the policy decision taken by the department and now their services are governed by the C.G. School education Services (Educational and Administrative Cadre Recruitment and Promotion Rules). Under the Rules of 2019/2026 post of Teacher (L.B.) Librarian was not created. Accordingly, proposal was forwarded by Director, Public Instructions to the Secretary, School Education Department mentioning that the post of Teacher (L.B.) Librarian (Level-08) is not sanctioned and for one time they may be accommodated as Shiksha Karmi (L.B.) Cadre, however on the letter dated 11.02.2022 respondent no. 1 has not taken any decision. 4. Petitioners have also submitted a representation before the Director, Public Instructions however no decision has been taken and therefore direction be issued to the respondent no. 2 to consider and take decision on the pending representation. 5. Counsel for the State submits that he is having no objection to the limited prayer. 6. I have heard learned counsel for the respective parties. 7. On due consideration of the submission of the counsel for the respective parties in particular to submission that the respondent no. 2 has already submitted a proposal before the respondent no. 5 1 on 11.02.2022 decision on which is still pending consideration, the writ petition at this stage is disposed of permitting the petitioners to submit fresh comprehensive representation before respondent no. 1-2 alongwith supporting documents and in the event such a representation is submitted, respondent no. 1 and 2 shall consider and take decision on the same in accordance with law expeditiously preferably within a further period of 4 months from the date of receipt of representation.
