Heard the parties.
The petitioner has moved this Court for grant of bail in connection with B.S. City P.S. Case No.39 of 2025 corresponding to G.R. Case No. 577 of 2025, S.T. Case No. 149 of 2025 registered for the offences punishable under sections 317(2), 317(4), 317(5), 338, 336(3), 340(2), 3(5) of the B.N.S., 2023.
The learned counsel for the petitioner submits that this is the second journey of the petitioner with the prayer for regular bail; as earlier the prayer for regular bail of the petitioner was rejected vide
order dated 21.07.2025 in B.A. No. 5844 of 2025. It is further submitted that the fresh ground is that only one witness has been examined and he has supported the case of the prosecution. Hence, it is submitted that the petitioner be admitted to bail.
The learned Addl. P.P. on the other hand vehemently opposes the prayer for bail and submits that keeping in view the fact that the sole witness who has been examined so far has supported the case of the prosecution is an aggravating factor which acts against the petitioner. Hence, it is submitted that the petitioner ought not to be admitted to bail.
Considering the fact that the prayer of bail of the petitioner was rejected on merit and the sole witness has supported the case
of the prosecution, this Court is not inclined to admit the petitioner on bail.
Accordingly, the prayer for regular bail of the above-named petitioner is rejected.
