Opposite Parties Represented by Adv. – Smt. S. Nayak, ASC CORAM: MR. JUSTICE ADITYA KUMAR MOHAPATRA ORDER 23.04.2026 Order No. 01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode). 2. Heard learned counsel for the Petitioners and learned Additional Standing Counsel for the State. Perused the records. 3. This is an application under Section 482 of the B.N.S.S., 2023 filed by the Petitioners for anticipatory bail, involving offence punishable under Sections 85/296/115(2)/109(1)/351(3)/3(5) of B.N.S. in C.T. Case No.292 of 2026 in the Court of learned J.M.F.C., Soro arising out of Soro P.S. Case No.184 of 2026. 4. It is stated by the learned counsel for the Petitioner that there exist a matrimonial dispute between the Petitioner No.3-husband and the informant-wife, as a result of which, the present criminal case has been registered falsely at the instance of the informant- wife implicating the husband and his family members. Learned counsel for the Petitioner further submitted that the informant has Page 2 of 3. not sustained any injury. He further contended that the Petitioner does not have any criminal antecedent and that he belongs to locality, therefore, there is no chance of his absconding. 5. Learned counsel for the State on the other hand, objected the release of the Petitioner on anticipatory bail on the ground of gravity and seriousness of the allegation. She further contended that the investigation is still on. Therefore, the release of the Petitioner at this juncture would cause delay in conclusion of the investigation. 6. Having heard the learned counsels appearing for the respective Parties, on a careful examination of the materials on record, further taking into consideration the nature and gravity of the allegation, I am not inclined to grant anticipatory bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders and move for bail before the learned court in seisin over the matter within a period of three weeks from today and moves an application for bail, the Court in seisin over the matter shall release him on bail in connection with the aforesaid case on such terms and conditions as it may deem just and proper in the facts and circumstances of the case. The release of the Petitioner shall also be subject to the following conditions:- I. shall not indulge in similar type of offences while on bail; II. shall not harass, threaten or terrorize the victim or any of the prosecution witnesses in any manner whatsoever; III. shall cooperate with the investigation and appear Page 3 of 3. before the Investigating Officer as and when his presence is required by the I.O. for the purpose of investigation. Violation of any of the terms and conditions shall entail cancellation of the bail. 7. It is further directed that the bail granted to the Petitioner shall be subject to the verification of injury report. In the event it is found that the injuries sustained by the injured are grievous in nature, then this order shall stand automatically revoked. 8. The ABLAPL is disposed of accordingly. Urgent certified copy of this order be granted as per rules. ( A.K. Mohapatra) Judge Sisir Designation: PERSONAL ASSISTANT
