The petitioner has been made accused in connection with Mahuda P.S. Case No. 124 of 2025(S.T. Case No. 659 of 2025), registered for the offences punishable under 310(2) of BNS. It is submitted by the learned counsel for the petitioner that this is the second journey of the petitioner with the prayer for regular bail and earlier the prayer for regular bail of the petitioner was rejected vide order dated 25.11.2025 in B.A. No. 9482 of 2025. It is next submitted by the learned counsel for the petitioner that the fresh ground is that in the meanwhile four witnesses have been examined including the informant and all of them have been declared hostile and they have not supported the case of the prosecution, even though the prosecution put leading question to them still they have not supported the case of the prosecution. It is next submitted that the allegation against the petitioner is false. It is then submitted that the petitioner has been in custody since 20.08.2025 as has been mentioned in para 01 of the bail application. It is then submitted that the petitioner has no criminal antecedent as has been mentioned in para 13 of the bail application. It is next submitted that the petitioner undertakes to cooperate with the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. Learned Addl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned JMFC Dhanbad, in connection with Mahuda P.S. Case No. 124 of 2025(S.T. Case No. 659 of 2025) with the condition that he will co-operate with the trial of the case, furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
