Borthakur, learned Additional Public Prosecutor, Assam and Mr. A Ghoshal, learned counsel representing the informant. By this application filed under Section 482 of the BNSS, 2023, the petitioner Sri Sumit Das has prayed for pre-arrest bail in connection with Dergaon P.S. Case No. 17/2026. Pursuant to the interim order dated 13.02.2026 the petitioner has appeared before the Investigating Officer Page No.# 2/2 and recorded his statement. Mr. Ghoshal, learned counsel appearing for the informant has submitted that the informant’s brother took a loan of Rs.2,50,000/- from the petitioner and being failed to return the same, he committed suicide. Mr. Ghoshal has further prayed before this Court that the interim order passed earlier in favour of the petitioner should not be made absolute. I have considered the submissions made by the learned counsel for both the sides. Since the petitioner has appeared before the Investigating Officer and cooperating in the investigation, he does not deserve to be detained in custody. Accordingly, the interim order dated 13.02.2026 passed by this Court is made absolute. The bail application is disposed of. Case diary be returned. JUDGE Comparing Assistant
