R.Thote, Advocate for applicant. Mr. U. Phasate, APP for non-applicant/State. CORAM: M. M. NERLIKAR, J . DATED : 07/09/2026. Heard. 2. By this application, the applicant is seeking bail in connection with Crime No.57/2021 registered with Police Station Umarkhed, Dist. Yavatmal for the offences punishable under Sections 307, 397, 395, 353, 332 of the Indian Penal Code, Sections 3(1)(iii), 3(2), 3(4) of the Maharashtra Control of Organised Crime Act. 3. It appears from the record that initially the applicant has been granted bail by the Trial Court on 07/05/2021 which was cancelled by this Court on 13/06/2022. Thereafter, the applicant has filed another bail application, however, this Court has again rejected the bail application on the basis of merits by its order dated 03/10/2024. It further appears that the applicant has 2 22 BA 953.26 approached the Apex Court twice, however, vide order dated 08/04/2025 passed in petition(s) for Special Leave to Appeal (Crl.) No(s). 1724/2025 as well as vide order dated 18/11/2025 passed in Miscellaneous Application No.1959/2025 in SLP (CRL) No.1724/2025, the Apex Court rejected the applications/SLPs of the applicant, however he was granted liberty to approach the Apex Court, if the trial is delayed. Accordingly, he again approached the Trial Court on merits, however, his application was rejected. So far as the merits are concerned, this Court and the Apex Court has shown its disinclination twice and accordingly the respective application/SLP has been rejected. Under such circumstances, there is no change in circumstances to entertain the application. 4. Considering the above facts and circumstances, the application is rejected. 5. Pending application (s), if any, stand disposed of. ( M. M. NERLIKAR , J.) Gohane Signed by: Mr. J. B. Gohane Designation: PS To Honourable Judge Date: 07/09/2026 19:19:08
