JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused Nos.2 to 4 under Section 483 of BNSS praying to grant bail in Cr.No.184/2025 of Peresandra Police Station, registered for the offences punishable under Sections 103(1), 190, 61, 55 of BNS. - 3 - HC-KAR NC: 2026:KHC:9419 CRL.P No. 50 of 2026 2. Heard learned counsel for the petitioners and learned HCGP for respondent/State. 3. Learned counsel for the petitioners would contend that the allegation against these petitioners in the complaint is that they abated accused No.1 to kill the deceased. There was civil dispute filed by the mother of deceased against accused No.1 and others. The petitioners were not present at the time of the incident. There are no criminal antecedents of the petitioners. The petitioners are in judicial custody since 09.10.2025 and therefore, they are not required for further custodial interrogation. Accused No.5 who is similarly placed to that of petitioners has been granted bail by this Court by order dated 06.01.2026 passed in Crl.P.No.15506/2025. With this he prayed to allow the petition. 4. Per contra, learned HCGP for respondent/State would contend that there is a civil dispute with regard to passage and the suit is pending in O.S.No.4/2023. The petitioners have abated accused No.1 to kill the deceased. - 4 - HC-KAR NC: 2026:KHC:9419 CRL.P No. 50 of 2026 The charge sheet material show prima-facie case against the petitioners for the offence alleged against them. With this she prayed to reject the petition. 5. Having heard the learned counsels, the Court has perused FIR, complaint, charge sheet and other materials placed on record. 6. On perusal of the charge sheet the case of the prosecution is that accused No.1 assaulted deceased with machete on his neck and caused his death. The allegation against the petitioners/accused Nos.2 to 4 is that they abated accused No.1 to kill the deceased. Admittedly, the petitioners were not present at the spot at the time of incident. Petitioners are in judicial custody since 09.10.2025 and as the charge sheet is filed, they are not required for further custodial interrogation. Accused No.5 who is similarly placed to that of these petitioners has been granted bail by this Court. Considering the above aspects, the petitioners have made out case for grant of bail with conditions. Petitioners/accused Nos.2 to 4 are granted bail in Cr.No.184/2025 of Peresandra Police Station, subject to following conditions: a) The petitioners/accused Nos.2 to 4 shall execute a personal bond for a sum of Rs.1,00,000/- each, with one surety for the like sum to the satisfaction of jurisdictional Court. b) The petitioners/accused Nos.2 to 4 shall not tamper the prosecution witnesses either directly or indirectly. c) The petitioners/accused Nos.2 to 4 shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
