The present appeal i.e., CRA No. 2477/2025 filed on 04.11.2025 and subsequent appeal CRA No. 2433/2025 filed on 13.11.2025 are arising out of same judgment of conviction and order of sentence dated 26.09.2025 passed by the Special Judge (N.D.P.S. Act) Korba, Dist. Korba in N.D.P.S. Act Case No. 13/2024. Previously filed appeal i.e., CRA No. 2477/2025 has been preferred by the same appellant, namely, Rakesh Sahu through High Digitally signed by ALLENA ANJANI KUMAR Date: 2026.04.22 17:29:13 +0530 2 Court Legal Services Committee, which engaged the counsel Shri Shreshtha Gupta whereas subsequent appeal, i.e., CRA No. 2433/2025 has been filed on behalf of same appellant through counsel Shri Prashant Sahu. Since two appeals against the same judgment of conviction and sentence are not maintainable, in the facts and circumstances of the case, the subsequent appeal, i.e., CRA No. 2433/2025 is liable to be disposed of as not maintainable and the CRA No.2477/2025 is maintainable. However, Shri Prashant Sahu, Advocate is permitted to appear in CRA No.2477/2025 along with Shri Shreshtha Gupta, Advocate. 2. In view of above, CRA No. 2433/2025 is disposed of as not maintainable.
