Sukumar, learned State counsel for MC (Miscellaneous Case) applicants is before Court (physical Court). [2] Captioned MC has been filed with a Condonation of Delay (CoD) prayer. [3] When the captioned MC application was taken up, it came to light that there are atleast two errors in computation of number of days delay sought to be condoned. One is, the date of filing of the writ appeal has been wrongly given as 12.06.2026 vide paragraph 5.1 of MC application whereas the correct date is 25.06.2026. In and vide the same paragraph i.e., 5.1 of MC application, another error has occurred and that is the reckoning date. The reckoning date has been taken as 06.10.2025 whereas the records before this Court show that State has made an application for certified copy only on 27.04.2026 though the impugned order was made on 23.09.2025. To be noted, the impugned order has been uploaded in the official website of this Court. [4] Faced with the above situation, learned State counsel sought leave of this Court to withdraw the captioned MC application and made a further plea to preserve all the rights and contentions of State to file a CoD MC afresh after making course correction. This request is acceded to but with a caveat that if a CoD MC is filed afresh, instant order shall be annexed as enclosure to fresh MC. [5] A scanned reproduction of endorsement made by learned State counsel for MC applicant in the case file as regards withdrawal is as follows: [6] Ergo, the sequitur is, captioned MC is disposed as withdrawn/closed albeit with preservation of rights and observations as above.
