Mr. Bhupesh Kandpal, Advocate for respondent No. 3. 2. By means of this writ petition, petitioner has sought the following reliefs: “I. Issue a writ order or direction in the nature of certiorari quashing/setting aside impugned letter/communication dated 10.04.2026 (marked as Annexure No. 1 to the writ petition at Pg. No. 18), issued by Respondent No. 3 University demanding an F.D.R. of Rs. 35 lakhs from the Petitioner College for the course of B. Pharm etc whereby the Petitioner College has been directed to complete the process of security amount as per the standards and the related records shall be made available to the University. II. Issue a writ, order or direction in the nature of mandamus, directing the Respondents not to demand any excess deposit from the Petitioner College for the purpose of affiliation and running of the Petitioner Institute.” 3. Mr. Bhupesh Kandpal, learned counsel appearing for respondent No. 3 submits that as per document enclosed with the writ petition, petitioner-college is affiliated with the Uttarakhand Technical University. He further submits that though petitioner is 2026:UHC:4586 seeking reliefs against H.N.B. Uttarakhand Medical Education University, but the said University has not been arrayed as party respondent. 4. This Court finds substance in the said contention raised on behalf of learned counsel appearing for respondent No. 3. 5. Since HNB Uttarakhand Medical Education University is a necessary party having regard to the reliefs claimed, the writ petition is dismissed on the ground of non- joinder of necessary party, with liberty to the petitioner to file a fresh writ petition for same cause of action.
