JUSTICE M.NAGAPRASANNA - 3 - HC-KAR NC: 2026:KHC:22824 CRL.P No. 5674 of 2026 ORAL ORDER The petitioners are before this Court calling in question the proceedings in Crime No.142 of 2026 of Yelahanka Police Station, Bengaluru city, pending before the VII Additional CMM Court, Bengaluru, registered for offences punishable under Section 106(1) of BNS, 2023. 2. Heard Sri Phaniraj Kashyap, learned counsel appearing for the petitioners, Sri B N Jagadeesha, learned Additional SPP appearing for respondent No.1, Sri S N Yadunandan, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the joint compromise petition. Terms of settlement reads as follows: "JOINT COMPROMISE PETITION UNDER SECTION 359 OF THE BHARATIYA NAGARIK SURAKSHA SANHITA, 2023 READ WITH SECTION 528 OF THE BHARATIYA NAGARIK SURAKSHA SANHITA, 2023 The Petitioners and the Respondent No. 2 above- named most respectfully submit as under: - 4 - HC-KAR NC: 2026:KHC:22824 CRL.P No. 5674 of 2026 1. The Petitioners have preferred the instant Criminal Petition under Section 528 of BNSS seeking to quash the proceedings in FIR No. 0142/2026 dated 19/03/2026, registered at Yelahanka Police Station, Bengaluru City, for the offence punishable under Section 106(1) of the BNS which is pending on the file of the 7th Addl. CMM Court, Bengaluru City. 2. During the pendency of the present petition, with the intervention of mutual friends, well-wishers, and elders, the Petitioners and Respondent No. 2 have amicably resolved and settled all their disputes and differences in relation to the incident dated 19/03/2026, which led to the registration of the aforesaid FIR. 3. The parties have entered into a Settlement Agreement dated 15-04-2026, the terms of which have been mutually agreed upon. The said settlement has been arrived at out of the free will and volition of the parties, without any force, fraud, coercion, misrepresentation, or undue influence from any quarter. 4. In terms of the aforesaid settlement, the Petitioners have paid a sum of INR 5,00,000/- (Rupees Five Lakhs Only) to Respondent No. 2 as a full and final settlement of all her claims and grievances. The said payment has been made purely on humanitarian and compassionate grounds as an ex-gratia payment and shall not be construed as an admission of guilt or liability by the Petitioners, which is expressly denied. The Respondent No. 2 has acknowledged the receipt of the said amount. 5. In view of the amicable settlement, the Respondent No. 2, who is the complainant and the wife of the deceased, does not wish to prosecute the criminal proceedings against the Petitioners and has no objection whatsoever to the quashing of the FIR No.0142/2026 and all proceedings emanating therefrom. The Respondent No.2 submit that there is no coercion compulsion on her to compound the offences and on her free will agreed to compound the - 5 - HC-KAR NC: 2026:KHC:22824 CRL.P No. 5674 of 2026 case. Hence this application seeking kind permission of this Hon'ble court to compound the offence. 6. That the continuation of the criminal proceedings against the Petitioners would be a futile exercise and an abuse of the process of the court, particularly when the complainant (Respondent No. 2) herself has resolved the matter and does not wish to proceed with the prosecution. 7. That this joint petition is being filed bona fide and in the interest of justice. The parties have filed a joint affidavit in support of this compromise petition. PRAYER WHEREFORE, the Petitioners and the Respondent No. 2 most humbly pray that this Hon'ble Court may be pleased to: a) Take this Joint Compromise Petition on record; b) Permit the parties to compound the offence and in furtherance thereof, exercise its inherent powers under Section 528 of the BNSS to quash the entire proceedings in FiR No. 0142/2026 dated 19/03/2026, registered at Yelahanka Police Station, Bengaluru City, or the offence punishable under Section 105(1) of the BNS, pending on the file of the 7th Addl. CMM Court, Bengaluru City, against the Petitioners in the interest of justice and equity." 4. The parties to the lis are present before the Court and are identified by their respective counsel. 5. In the light of application for compounding being filed along with the joint compromise petition and offences not being against the State, I deem it appropriate to accept the - 6 - HC-KAR NC: 2026:KHC:22824 CRL.P No. 5674 of 2026 compounding application and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER i. Criminal Petition stands disposed. ii. Proceedings pending in Crime No.142 of 2026 of Yelahanka Police Station, Bengaluru city, pending before the VII Additional CMM Court, Bengaluru, against the petitioners stands quashed.
