He submits, on instructions, that the substantive proceeding, namely, the Arbitration proceedings before the Arbitrator appointed under the provisions of the National Highways Act is over, and the present appellant has challenged the said award under Section 34 of the Arbitration and Conciliation Act, and it is pending before the District Court, Nagpur.
