By this petition, the petitioner has made a limited prayer seeking direction to respondent No.1-The Scheduled Tribe Certificate Scrutiny Committee, Nagpur to decide the caste claim expeditiously.

The petitioner claims to be “Mana” Scheduled Tribe, a student and his caste claim was forwarded on 13.10.2025 to the respondent No.1-Committee and still it is pending. Now the petitioner is admitted in respondent No.2- K.D.K. College of Engineering in the branch of Engineering. However, there is an apprehension that he would loose his admission for want of caste validity certificate as the production of validity certificate is a pre condition. Heard learned counsel for the petitioner, who reiterated the said contention and submitted that considering the apprehension the Committee be directed to decide the claim expeditiously and respondent Nos.2 to 4 shall be
directed not to cancel the admission of the present petitioner for want of validity certificate.

Per contra, learned AGP for the respondent No.1/State submitted that being it is a pre condition, the prayer of the present petitioner deserves to be rejected.

Learned counsel for the respondent Nos.3 and 4 also reiterated the said contention.

Considering the petitioner is a student, now this aspect is already considered by the State Government by issuing notification on 04.09.2026 extending the time limit for production of validity certificate by three months. However the Scheduled Tribe is excluded from the said category. We are of the considered opinion that such type of the benefit can be extended to the Scheduled Tribe also.

In view of that, we allowed the petition with following direction.

Hence we proceed to pass the following order:- (i) Writ Petition is allowed. (ii) Respondent No.1/Committee shall decide the caste claim of the petitioner within six months. (iii) Respondent Nos.2 to 4 shall not cancel the admission of the present petitioner for want of validity certificate.
3 17 wp 7083.26.odt..odt (iv) The admission of the present petitioner would be subject to the final outcome of the caste claim otherwise he is eligible for admission. (v) The petitioner shall not seek any equity on this ground.

The petition is disposed of. No costs.
