1. This second bail application under Section 483 of BNSS is filed by the applicant-accused Ramchandra S/o Late Shri Chatralal, seeking bail in respect of a criminal case registered as FIR No.63/2025 dated 09.03.2025 registered at P.S. G.R.P. Kota District-Ajmer, for the offence under Sections 8/20 of NDPS Act.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the matter and the investigation against him is complete and he is no more required in investigation. He further submits that there are no chance of fleeing of applicant accused from the jurisdiction of this Hon’ble Court. He also submits that the

Learned counsel for petitioner submits that first bail application of present petitioner was dismissed as withdrawn on 27.08.2025 but now charge-sheet has been filed. He further submitted that there is no recovery from the petitioner and the petitioner is charge under Section 8/29 of NDPS Act on the basis of statement made by co-accused. He further referred bail order dated 26.05.2025 in respect of main accused Asif and submitted that main accused is already released on bail. At last, he submitted that present petitioner is in custody for last few months and still the trial has not begun. 4. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the allegations are grave and serious in nature. He further submitted that nine other criminal cases were registered against present petitioner. 5. Heard learned counsel for the petitioner-accused and learned Public Prosecutor. Perused the material placed on record by both the parties. 6. On the basis of recovery of 7kg 819 gm of Ganja from Asif on 09.03.2025 at the time of Nakabandi FIR no. 63/2025 was registered at Police Station Kota, District G.R.P., Ajmer under Section 8/20 of NDPS Act. During investigation, the name of present petitioner was revealed and present petitioner was arrayed as an accused under Section 8/29 of NDPS Act. [2026:RJ-JP:9727] (3 of 3) [CRLMB-1548/2026]

The bail order passed by the trial court indicate that total nine criminal cases were registered against the petitioner and out of which seven cases pertains to NDPS Act which is sufficient to indicate that the petitioner is regularly involved in matters relating to contraband articles. There is one conviction under the NDPS Act but remaining cases are pending. The criminal background particularly relating to NDPS Act is sufficient not to grant bail to the petitioner. 8. The facts and the material indicate that the alleged offence are of serious nature and role attributed to applicant is prima facie sufficient to consider complicity of applicant in the crime. Therefore, at this juncture, considering the evidence collected so far, this is not a fit case to enlarge the applicant accused on bail. 9. Considering the gravity of allegations and overall facts and circumstances of the case, it is appropriate to dismiss the bail application of the applicant accused at this stage. 10.
Accordingly, the second application for bail filed under Section 483 of BNSS preferred by Ramchandra S/o Late Shri Chatralal is hereby dismissed. 11. The trial court is directed to expedite the trial and record the statement of Search and Seizure Officer and independent witness, if any, on priority basis. (ASHOK KUMAR JAIN),J CHETNA BEHRANI /29
