Heard learned counsel Shri Ashwin Deshpande for the petitioner; learned Additional Government Pleader Mrs.S.S.Jachak for respondent No.1, and learned counsel Shri Nikhil Gaikwad for respondent No.2. 2. By this petition, the petitioner seeks a limited prayer to direct respondent No.1/The District Caste Certificate Scrutiny Committee, Yavatmal to decide caste claim of the petitioner belonging to “Mathura Labhan Vimukta Jatis-A.” 3. As per contentions of learned counsel for the petitioner, the petitioner has obtained Caste Certificate of “Mathura Labhan” recognized as “Vimukta Jatis-A.” Initially, the caste claim of the petitioner was forwarded for validation. However, the same was rejected. Now, again, 2026:BHC-NAG:11825-DB 2 1 wp7070.26.odt the caste claim of the petitioner was forwarded on 19.6.2026 which is pending. Now, the petitioner, who is a student, is admitted in respondent No.3/College for Engineering Course from the Category of “Mathura Labhan Vimukta Jatis-A.” However, respondent Nos.2 and 3 are insisting for Caste Validity Certificate. As the caste claim of the petitioner is pending with the said Committee, the petitioner is unable to produce Caste Validity Certificate. Therefore, there is likelihood of loosing the admission. In view of that, the petitioner is seeking directions. 4. Considering the State Government by issuing circular on 4.9.2026 extended period to produce Caste Validity Certificates within three months, as far as SBC and OBC Categories and other castes are concerned, excluding the Scheduled Tribe Category, the said benefit can be extended to the petitioner also who claims to be “Mathura Labhan”. 5. The Seat Allotment Letter produced on record shows that the petitioner is already admitted in respondent No.3/College. Considering the same, we are of a considered opinion that the present writ petition deserves to be disposed of as per following order: ORDER (1) The Writ Petition is allowed. 3 1 wp7070.26.odt (2) The respondent No.1/The District Caste Certificate Scrutiny Committee, Yavatmal is directed to decide the caste claim of the petitioner within a period of three months after receipt of Vigilance Report. (3) It is directed that respondent Nos.2 and 3 shall not cancel the admission of the petitioner which is from the Category of “Vimukta Jatis-A.” (4) The admission of the petitioner would be subject to final outcome of the caste claim of the petitioner decided by the said Committee. (5) The petitioner shall not seek any equity on this ground. (6) With these directions, the writ petition is disposed of. No costs.
