And In the matter of: Arman Mandal @ Alamin Mandal …. Petitioner Ms. Busra Khatun …for the petitioner Mr. Ranadeb Sengupta Mr. Sourat Nandy ..for the State Learned counsel appearing on behalf of the petitioner submits that other than the statements of a co-accused which is not admissible in evidence, there is no other incriminating material available in the case diary against the present petitioner. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. In the present case, some contraband was recovered from a car pursuant to the statements of the person driving the car. A godown was raided. A huge quantity of contraband was recovered from there. The godown-in-charge stated that the present petitioner accompanied the car in a motorbike and had the goods loaded. Apart from that, there are phone call conversations between the petitioner and the ultimate consignee who has also been arrested. Considering the above and the other incriminating materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail. 2 Accordingly, the application for anticipatory bail of the petitioner is rejected.
