The statement of victim girl recorded under Section 183 of the BNSS has been produced before this Court in the sealed cover. 3. This bail application has been filed by the petitioner under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 137(2), 352, 351(2), 115(2) & 3(5) of the Bharatiya Nyaya Sanhita. 4. Heard, learned counsel for the petitioner and learned counsel for the State and have also gone through the impugned order. 5. Learned A.P.P. opposes the prayer for bail. 6. In the statement recorded under Section 183 of BNSS, the victim has made following statement, which reproduce in english:- “I have been in love with Kanhaiya Paswan since 2 and ½ years. When he went to Hyderabad, my parents got me married without my consent. I use to frequently visit my matrimonial home. When Kanhaiya came home one month ago it is I who told him to run away with me. On 30.11.2025, I and Kanhaiya went to Bangalore and from there to Hyderabad. I stayed in Hyderabad for ten days. When police called, we returned. On 16.10.2025 we went to the police station. My husband has an affair with another girl, he used to beat me. I do not want to live with him. I want to live with Kanhaiya. Kanhaiya did not do anything forceful with me.” 7. Considering the statement of the girl, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Godda in connection with Godda (Muffassil) Police Station Case No.218 of 2025 subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his/her own name within the State of Jharkhand. 8.
