The instant writ application was preferred by the petitioner for the following reliefs: For quashing the letter dated 15/02/2019 (Annexure 11), issued by Controller of Examination, Respondent No.04, as far as it relates to the petitioner whereby & whereunder, the Petitioner's candidature has been rejected in view of the Order dt.01/11/2018, passed by the Hon'ble Apex Court, in Civil Appeal No.8425/2013, based on which the Respondent No.2 has issued letter no.235, dt. 10/01/2019, as, the said dictum does not applies to this Petitioner, who was born in united Bihar, and in consequence thereof be further pleased to direct the concerned respondents to issue appointment letter to the Petitioner as the caste certificate submitted by her has been issued long before the publication of advertisement, by the prescribed authority in the appropriate form, in terms of the advertisement. 3. The grievance of the petitioner in the instant case is that though she was selected in the written examination and was also called for verification of 2026:JHHC:10971 2 documents, but since the petitioner belonged to S.C Category of the erstwhile State of Bihar, she was asked by the respondent authority to produce the certificate in the name of his father because for the reason the certificate which was produced by the petitioner was in the name of her husband. Thereafter, when she submitted the caste certificate in the name of his father issued by the authorities of Bihar her claim for appointment was rejected. 4. From the records, it appears that advertisement was issued in the year 2017 pursuant to which written examination was conducted and the result was published on 15.2.2019 and thereafter petitioner filed this case on 18.6.2019; thus almost 8 years have lapsed and since the last candidate appointed has not been made party in this case, so even interfering with the order at this stage would certainly hamper the career of a person, who has already been selected and working since the year 2019. 5. Accordingly, no relief can be granted to the petitioner, at this stage. As a result, the instant writ application stands dismissed. Pending I.A(s), if any, stands closed.
