The prosecution's story alleges that the applicant intoxicated the victim-deceased with liquor and subsequently drowned him in water. However, it is submitted that the entire case of the prosecutions rests upon weak circumstantial evidence, specifically the mere recovery of a boot from the applicant and a pyajama from the co-accused. It is lastly submitted that the applicant has been in custody since long, and that there are no criminal antecedents registered against the applicant. 3. Per contra, learned Public Prosecutor has vehemently opposed the instant bail application and has submitted that incriminating articles have been recovered from the applicant and that the allegations of heinous offence have been levelled against the applicant. 4. Having heard the arguments advanced by learned counsel for the parties and taking note of the fact that the applicant is a young man, aged about 32 years; that the applicant is sole bread earner of his family; that the applicant has been in prolonged custody since long; that there are no criminal antecedents registered against the applicant, and looking to the overall facts and circumstances of the case but without commenting on the merits/demerits of the case, this Court is inclined to allow the bail application of the accused-applicant and enlarge him on bail. 5. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Bhajanlal @ Bhujiya S/o Bhoop Singh shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
