Petitioner filed a suit for permanent prohibitory injunction with temporary injunction application. Learned Trial Court granted interim injunction in favour of the petitioner, vide order dated 19.08.2025, however the order of temporary injunction was later vacated while deciding the application filed by petitioner under Order 39 Rule 1 & 2 CPC. 3. Petitioner has now filed a Misc. Appeal before the Appellate Court, which is numbered as Misc. Civil Appeal No. 35 of 2026, which was filed on 30.05.2026. 4. Appellate Court directed for issuance of notice and fixed the matter for 02.07.2026. Petitioner has approached this Court for protection. 5. This Court is not inclined to grant the relief, as prayed for. Since the Trial Court has returned a finding that petitioner was not able to make out a prima facie case and that finding is under challenge before the First Appellate Court, therefore, any interference by this Court, at this stage, will not be proper. 6. The writ petition is, however, disposed of with a request to Appellate Authority to make endeavour to decide the application for interim relief filed by petitioner, as early as possible.
