DATE : 07.09.2026 By this application, the petitioner is seeking to amend the petition by adding the parties as respondent No.3, Yashwantrao Chavan College of Engineering and respondent No.4, State Common Entrance Test Cell, Government of Maharashtra as well as pleading in Para No.25- and also seeks to add prayer clause in the petition. 2. In view of the reasons mentioned in the application, Civil Application No.2287/2026 is allowed. 3. Amendment be carried out forthwith. Prity 2 / 3 4.caw2287.2026 Writ Petition No.6256/2026 On adding the Nos.3 and 4, as a party, learned Counsel Mr. Nikhil Gaikwad, waives service of notice on behalf of the respondent Nos.3 and 4. 2. By this petition, the present petitioners made a limited prayer i.e. directions to the respondent No.1 – Scheduled Tribe Certificate Scrutiny Committee, Nagpur to decide the caste claim of the petitioners expeditiously. 3. Heard learned counsel for the petitioners, who submitted that the petitioners belongs to ‘Halba’ Schedule Tribe. The caste claim of the present petitioners was forwarded on 03.05.2025 for the validation to the respondent No.1 – Committee, however, still, the claim is pending with the respondent No.1- Committee. Now, the petitioner No.1, who is a student, allotted seat for B.Tech. from the Schedule Tribe Category and now, the precondition is to submit the validity certificate. Due to the pendency of the caste claim, the petitioner No.1 is unable to produce the validity certificate and therefore, petitioners are having apprehension of cancellation of admission of petitioner No.1. 4. Now this aspect has already been considered by the State Government and the State Government has already extended these benefits to the SBC, OBC and Scheduled Caste and also extended the time to produce a validity certificate by three months. The said Prity 3 / 3 4.caw2287.2026 benefits can be extended to the Scheduled Tribe as the State Government has not clarified why the schedule Tribe is not considered in the said notification. 5. In view of that, the prayer of the present petitioners to the extent of direction to the respondent No.1 and to the newly added respondent Nos.3 and 4 not to cancel the admission of petitioner No.1 deserves to be allowed. In view of that, we proceed to pass the following order. O R D E R (i) Respondent No.1 – Scheduled Tribe Certificate Scrutiny Committee, Nagpur, is directed to decide the caste claim of the petitioners within six months. (ii) Till then, the respondent No.3 and 4 shall not cancel the admission of the petitioner No.1. The admission of the petitioner No.1 would be subject to the outcome of the result of the caste claim of the petitioners. The present petitioners shall not seek any equity on that ground. 6.
