Petitioners have filed this writ petition seeking following reliefs: 10.1 That, this Hon’ble Court may quash and set aside the promotion order dated 23.07.2025 bearing no. 3137/Lfkk/Vhlh/ 2025 to the extent it excludes the petitioner from promotion to the post of Assistant Grade-I while granting such promotion to his juniors. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondents to consider and grant promotion to the petitioner to the post of Assistant Grade-I (Pay Matrix Level-7) from the same date on which his immediate junior has been promoted, with all consequential benefits including fixation of pay, arrears and seniority above his juniors. 10.3 That this Hon’ble Court may kindly be 3 pleased to direct the respondents to grant the petitioner consequential benefits including fixation of pay, arrears from the date 23.07.2025. 10.4 That the Hon’ble Court may kindly be pleased to allow liberty to the petitioner’s to apply for fresh representation for the respondent to pass a reasoned and speaking order within a time bound period. 10.5 Any other relief or reliefs that may be deemed fit and proper in the facts and circumstances of the case may be also kindly be granted. 2. Learned counsel for the petitioner submits that the petitioner while working on the post of Assistant Grade-III became eligible for promotion to the post of Assistant Grade-II. When the respondent no. 2 issued a promotion order dated 23.07.2025 name of the petitioner does not find place. From the annexure P/1, it is evident that the juniors of the petitioner have been promoted superseding the petitioner. He further prays for a direction to the respondent no. 1 and 2 to consider and decide his representation within a stipulated time. 3. On the other hand, learned counsel for the respondent/State prays for time to file reply. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the 4 respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, without entering into the merits of the claim of petitioner, this Court finds it appropriate to dispose of this writ petition at this stage permitting petitioner to submit fresh representation and in the event petitioner submits a representation before respondent no. 1 and 2, the concerned authority is directed to consider and take decision on the representation to be 6. submitted by the petitioner in accordance with law, expeditiously, preferably within a period of 3 months from the date of receipt of representation. 7.
