DATE : 07.09.2026 By this petition, the petitioner has made a limited prayer i.e. direction to the respondent No.4 – the Scheduled Tribe Certificate Scrutiny Committee, Nagpur to decide the caste claim of the petitioner expeditiously within a period of 15 days. 2. Heard learned counsel for the petitioner, who submitted that the petitioner belongs to the ‘Mana’ Scheduled Tribe. His caste claim was forwarded on 17.07.2026 and it is pending with the Committee. He submitted that now the petitioner is allotted a seat for MBA course in KDK College of Engineering, Nagpur. However, as his caste claim is not decided, there is every possibility of petitioner losing the seat and therefore, he Prity 2 / 3 3.wp6512.2026 seeks directions to the Committee as well as to the respondent Nos.1 and 2 not to cancel his admission. 3. Learned AGP and learned counsel Shri Nikhil Gaikwad pointed out that the petitioner in the college is admitted from the open category as his allotment letter reveals that his admission is against the open category and therefore, the prayer of the present petitioner deserves to be rejected. 4. After hearing both the sides and on perusal of the allotment seat, it reveals that the present petitioner’s category mentioned as ‘Scheduled Tribe’ as well as the admission category is also ‘Scheduled Tribe’. However, his admission was converted into the open category. The acknowledgment of the payment of fees also shows that the amount of fees obtained by the respondent No.1 – College is Rs.2,500/- whereas the allotment seat shows that the admission fees from the open category requires to be paid Rs.6,000/-. It means that the respondent No.1 has accepted the candidature of the present petitioner from the Scheduled Tribe category. 5. In view of that, we direct the respondent Nos.2 and 4 to decide the caste claim of the petitioner within a period of four months. Prity 3 / 3 3.wp6512.2026 6. The respondent Nos.2 and 4 shall not insist for the validity certificate and shall not take any coercive action against the petitioner cancel his admission.
