Johnson, learned counsel representing learned counsel on record for ‘Miscellaneous Case’ (‘MC’ for the sake of brevity and convenience) applicant, Mr. Phungyo Zingkhei, learned State counsel on record for respondent Nos. 1, 2, 61 and 62, Mr. Rendy Maibam, learned counsel representing learned counsel on record for respondent Nos. 4, 5, 6, 8, 9, 10, 52, 53, 55 and 60, Mr. U. P a g e 4 | 5 As regards respondent Nos. 19, 33 and 46, steps have been taken, service has been duly effected but they have neither chosen to enter appearance through counsel nor come before this Court (either in the Physical Court or on the Video Conferencing (VC) platform). [2] Mr. S. Johnson, learned counsel representing learned counsel on record for MC applicant submits that respondent Nos. 21 and 29 in W.A. No. 87 of 2022 remain unserved and that has necessitated instant application. [3] Mr. Kh. Tarunkumar, learned senior advocate appearing on behalf of Mr. S. Johnson, learned counsel for MC applicant submits that captioned MC viz., MC(WA) No. 39 of 2026 has been taken out with a prayer to allow applicant to serve respondent Nos. 21 and 29 in W.A. No. 87 of 2022 by resorting to Dasti Service or Speed Post. [4] Prayer in captioned MC(WA) No. 39 of 2026 reads as follows: ‘PRAYER (i) allow the applicant/writ appellant to take steps upon Respondent no. 21 and 29 by way of Dasti Service or speed post. (ii) pass any other appropriate order/direction that this Hon’ble Court deems fit and proper.’ [5] Though the prayer seeks permission to serve by resorting to Dasti Service or Speed Post, learned senior counsel for MC applicant P a g e 5 | 5 submits that it is desirable to order Dasti Service alone. Learned senior counsel further submits that though prayer does not mention WA number, it is for effecting service qua R21 and R29 in W.A. No. 87 of 2022. This submission is recorded. [6] Captioned MC which is of the year 2026 is in pending writ appeal of the year 2022. Registry ought not to have processed and numbered the captioned MC without this being clearly mentioned in the cause-title as well as in the prayer. Registrar (Judicial) is directed to enquire into the matter, fix the responsibility and place a note before Chief Justice on the administrative side. [7] Considering the innocuous nature of the prayer, the same is not opposed by respondents. [8] Captioned MC(WA) No. 39 of 2026 is allowed/ordered making it clear that MC applicant is allowed to take steps to effect service on respondent Nos. 21 and 29 in W.A. No. 87 of 2022 by resorting to Dasti Service, returnable by 08.09.2026. [9] Captioned MC application is disposed of in the aforesaid manner. There shall be no order as to costs.
