1. Mr. Akib Mohammad, Advocate holding brief of Mr. Pankaj Miglani, learned counsel for the petitioner.
2. Mr. Rahul Verma, learned Additional Advocate General for the State of Uttarakhand.
3. Uttarakhand Regional Transport Authority, Dehradun issued an advertisement on 09.02.2018, whereby objections were invited from transport operators against grant of stage carriage permit. Challenging the said advertisement, this writ petition was filed.
4. Learned State Counsel submits that even though petitioner had opportunity to file objection, but he did not file any objection, therefore, the challenge thrown by petitioner to the advertisement is not maintainable. Her further submits that against grant of permit, petitioner-transport operator has remedy of approaching the State Transport Appellate Tribunal under Section 89 of Motor Vehicles Act.
5. The said contention is not disputed by
learned counsel for the petitioner.
6. Since, petitioner has alternate statutory remedy, therefore, the writ petition is dismissed on the ground of alternate statutory remedy with liberty to petitioner to approach the Appellate Forum.
