The Court made the following: 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.20221 of 2026 O R DE R: The Writ Petition is filed questioning the action of the Respondents in not considering the representations of the Petitioner dated 25.06.2026 and 26.05.2026 for consideration of his case for promotion to the post of Deputy Executive Engineer as provided vide A.P. Roads and Buildings Engineering Service Rules, 1996, framed vide G.O.Ms.No.103 Transport, Roads and Buildings (SER.II) Department, dated 22.05.1996. 2. The Petitioner was initially appointed as Helper in the Andhra University in January, 2009 and subsequently, he was promoted to the cadre of the Assistant Engineer (AEE) in course of time after acquiring requisite qualifications. Now, the Petitioner seeks for promotion to the post of Deputy Executive Engineer and placed reliance upon the AP Roads and Buildings Engineering Service Rules, 1996, for consideration of his case for promotion. He further submits that representations were given on 25.06.2026 and 26.05.2026 for consideration of his case for promotion in terms of thereof. 3 3. Learned Standing Counsel appearing for the Respondent University would submit that the AP Roads and Building Engineering Services Rules,1996, are not applicable to the Andhra University and therefore, the reliance placed by the Petitioner on the said Rule is misplaced. He further submits that the case of the Petitioner for promotion will be considered as and when the Department undertakes to effect promotions. 4. Heard the learned counsels. 5. Considering the submissions made, the Writ Petition is disposed of with the following directions: i) The Respondent Authorities are directed to consider the representations dated 25.06.2026 and 26.05.2026 for promotion to the post of Deputy Executive Engineer in accordance with the rules in vogue as and when the Department intends to undertake promotions to the said post. ii) There shall be no order as to costs.
