CRL OP No. 1815 of 2026 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 28-01-2026 CORAM THE HONOURABLE MR.JUSTICE K.RAJASEKAR CRL OP No. 1815 of 2026 R.Kabilan Petitioner(s) Vs State rep by the Inspector of Police Perumanallur Police Station, Tiruppur District Respondent(s) PRAYER Criminal Original Petition filed under Section 483 of BNSS, to enlarge the petitioner on bail in Spl.SC.No. 27 of 2024 pending on the file of the honourable sessions judge Mahalir Neethimandran at Tirupur. For Petitioner(s): Mr.V.Karthick For Respondent(s): Mr.A.Gopinath Government Advocate (Crl.side) ORDER The petitioner, who was arrested and remanded to judicial custody on 16.09.2025 based on execution of NBW dated 02.09.2025 in Spl.SC.No.27 of 2024 pending trial on the file of the learned Sessions Judge, Mahalir Neethimandram, Tirupur for the offences punishable under Sections 366, 343, https://www.mhc.tn.gov.in/judis CRL OP No. 1815 of 2026 376(3) of IPC 5(1) r/w 6 of POCSO Act, seeks bail. 2.It is a case of jumped bail. 3.The earlier bail application of the petitioner was dismissed by this Court, vide order dated 17.11.2025 in Crl.O.P.No.31326 of 2025 for the following reasons: “6.On a perusal of the order of the trial Court, it reveals that the petitioner was earlier absconded and thereafter, he was arrested and released on bail. Subsequently, once again, he was arrested and NBW has been issued and was rearrested. Apart from this, it is also stated that the petitioner has involved in nine previous cases. Now the case is pending for examination of witnesses and that already 13 witnesses were examined out of 21 list of witnesses. 7. This Court is of the view that if the petitioner is granted bail at this stage, he would hamper the trial process and accordingly this Criminal Original Petition stands dismissed. However, this Court gives direction to the trial Court to dispose of the case in Spl.S.C.No.27 of 2024 as early as possible.” 4. Heard the learned counsel appearing for the petitioner. https://www.mhc.tn.gov.in/judis CRL OP No. 1815 of 2026 5. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and upon instructions reported that the trial in this case was progressing and out of 21 witnesses already 18 witnesses were examined and now the case is posed for further witnesses on 05.02.2026. 6. Considering the fact that the trial is progressing and the present bail petition is filed without any change of circumstances after the dismissal of the earlier bail application in Crl.O.P.No.31326 of 2025 of 2025, this Court is not inclined to grant bail to the petitioner. 5. Accordingly, this criminal original petition stands dismissed. 28-01-2026 gbi Index:Yes/No Speaking/Non-speaking order Internet:Yes Neutral Citation:Yes/No https://www.mhc.tn.gov.in/judis CRL OP No. 1815 of 2026 To 1.State rep by the Inspector of Police Perumanallur Police Station, Tiruppur District Cr.No.356 of 2023 2.The Public Prosecutor, High Court of Madras. https://www.mhc.tn.gov.in/judis CRL OP No. 1815 of 2026 K.RAJASEKAR J. gbi CRL OP No. 1815 of 2026 28-01-2026 https://www.mhc.tn.gov.in/judis
