1. Heard, Mr. Sandeep Koregave, learned Advocate for the Applicant, and Mr. Vaibhav R. Gaikwad, learned Advocate for the Respondent. 2. This Application under Section 24 of the Code of Civil Procedure, 1908, is at the instance of the Applicant (husband), who seeks the transfer of the Hindu Marriage Petition No. A-178 of 2024, pending before the Family Court, Satara, to the Family Court, Kolhapur. The request made by the Applicant is on the ground that the Applicant has the responsibility of maintaining the minor daughter (aged 11 years), VRJ 1
906 - MCA - 2 - 2026.doc born out of wedlock with the Respondent (wife) and as such, it is difficult for the Applicant to travel to Satara to attend the Court proceedings. 3. Mr. Sandeep Koregave, learned Advocate for the Applicant, states that due to the Applicant's responsibility towards his minor daughter (Rachana), who has a medical condition requiring parental assistance, it is inconvenient and causes considerable hardship for the Applicant to travel to Satara. Mr. Sandeep Koregave, learned Advocate for the Applicant, therefore, as an alternative, submits that the Applicant would bear the travelling expenses of the Respondent to attend the Family Court, Kolhapur. 4. Mr. Vaibhav Gaikwad, learned Advocate for the Respondent, though disputing the medical condition sought to be put forth by Mr. Sandeep Koregave, learned Advocate for the Applicant, submits that the Respondent would agree and consent to the transfer of Hindu Marriage Petition No. A-178 of 2024 from Satara Court to the Family Court, Kolhapur on two conditions: (a) that, pending the decision of the Family Court on the visitation/custody rights of the minor child (Rachana), the Applicant should grant the Respondent visitation rights twice a month; and (b) that the Applicant should pay the Respondent's travelling expenses for attending the proceedings from her place of abode at Satara to Kolhapur. Sandeep Koregave, learned Advocate for the Applicant, on instructions from the Applicant, submits that the Applicant agrees to pay travelling expenses of Rs. 1,000/- per date of hearing Hindu Marriage Petition No. A-178 of 2024. He further without prejudice to any of the rights and contentions of the parties, states that the Applicant shall grant the Respondent visitation rights of the minor child (Rachana) on the first and third Saturdays of each month, commencing on 11th September 2026 and thereafter on every first and third Saturday. 6. Mr. Vaibhav R. Gaikwad, learned Advocate for the Respondent, agrees to the visitation rights as offered by the Applicant. 7. Mr. Sandeep Koregave, learned Advocate for the Applicant and Mr. Vaibhav R. Gaikwad, learned Advocate for the Respondent, state that the visitation would take place at the ‘Children's Visiting Room’ of the Family Court, Kolhapur. 8. Mr. Sandeep Koregave, learned Advocate for the Applicant and Mr. Vaibhav R. Gaikwad, learned Advocate for the Respondent, agree that the visitation hours shall be from 11:00 a.m. to 4:00 p.m. on the visitation days. 9. In view of the above, Miscellaneous Civil Application No. 2 of 2026 is disposed of by consent of the parties on the following terms: a) The Hindu Marriage Petition No. A-178 of 2024 pending before the Family Court, Satara, is withdrawn and transferred to the Family Court, Kolhapur. b) The Applicant shall provide visitation rights of Rachana (minor daughter of the Applicant and the Respondent) to the Respondent on the first and third Saturday of each month from 11:00 a.m. to 4:00 p.m. The visitation shall take place at the ‘Children's Visiting Room’, Family Court, Kolhapur. c) To begin with, the visitation of Rachana shall commence from 11th September 2026, from 11:00 a.m. to 4:00 p.m., at the ‘Children's Visiting Room’, Family Court, Kolhapur. d) The Applicant shall pay Rs. 1,500/- to the Respondent on each date of hearing in Hindu Marriage Petition No. A-178 of 2024 before the Family Court, Kolhapur, as travelling expenses.
The said amount shall be paid at least two (2) days in advance to the account details to be provided by the Respondent to the Applicant VRJ 4
906 - MCA - 2 - 2026.doc within one (1) week from today. e) Mr. Sandeep Koregave, learned Advocate for the Applicant, and Mr. Vaibhav R. Gaikwad, learned Advocate for the Respondent, state that the parties shall cooperate to ensure that the Respondent - mother meets minor child (Rachana) without any hindrance. 11. The above is a workable arrangement, agreed to with the consent of the Applicant and the Respondent. The Family Court shall not be influenced by this arrangement while deciding the rival claims of the parties or while deciding either the Application for visitation or the Application for custody of Rachana. To clarify, the said Application/s be decided on its own merits and in accordance with law. 12. Miscellaneous Civil Application No. 2 of 2026 is disposed of. (ASHWIN D. BHOBE, J.)
