This writ petition has been filed by the petitioner seeking a direction to respondents to convene the review D.P.C. for promotion on the post of Chief Administrative Officer, with the respondent-department.

It is the contention of petitioner that he was working as Senior Administrative Officer on the relevant period and was posted at I.T.I. (Boys), Dehradun. The promotional exercise was undertaken to the post of Chief Administrative Officer. As per Rules, petitioner has to complete one year service on 01.07.2017, the recruitment year, as Senior Administrative Officer for promotion on the post of Chief Administrative Officer.

The record reveals that petitioner was promoted on the post of Senior Administrative Officer on 29.06.2016 and he joined on the said post on
06.07.2016.

The date of consideration of length of service is 1st day of July of the recruiting year i.e.01.07.2017. Since, petitioner joined on the promotional post on 06.07.2016, therefore, on 01.07.2017, petitioner had not been completed requisite service of one year for

consideration for promotion on the post of Chief Administrative Officer and accordingly, petitioner’s claim for promotion was rejected. Feeling aggrieved, petitioner is before this Court.

Learned counsel for petitioner submits that since petitioner was promoted on the feeding post i.e. Senior Administrative Officer on 29.06.2016, therefore, he fulfills the criteria of one year service and is eligible to be promoted to the post of Chief Administrative Officer. He further submits that in between, petitioner has retied on 31.05.2018 and he can be given notional promotion.

Since, promotional order dated 29.06.2016 itself says that promotional order would be enforced from the date of joining on the promotional post and petitioner joined on 06.07.2016, petitioner had not completed 01 year requisite service on 01.07.2017 of recruitment year. Thus, he could not be considered and promoted to the post of Chief Administrative Officer. Accordingly, there is no reason to interfere in the present writ petition.

In view of the above, the present writ petition fails and the same is accordingly dismissed.
