Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ or direction preferably writ of mandamus declaring the action of the respondents 3 and 4 in not releasing the Essential Commodities to the petitioner in respect of FP Shop FP Shop No.1332021, Chindukur Village, Gadivemula Mandal, Nandyal Dist., without any order of suspension or cancellation and without following the procedure as contemplated under AP State Targeted Public Distribution System (Control) Order, 2018 apart from violation of the principles of natural justice and consequently direct the respondents to release Essential Commodities in favour of the petitioner as usual and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to Direct' the respondents 3 & 4 to release Essential Commodities to the F Shop No.1332021, Chindukur Village, Gadivemula Mandal, Nandyal Dist., forthwith, pending disposal of the writ petition. ORDER
The above writ petition is filed to declare the action of respondents 3 and 4 in not releasing the essential commodities to the petitioner in respect of FP Shop No.1332021, Chindukur village, Gadivemula Mandal, Nandyal District, without initiating any disciplinary proceedings as per the Andhra Pradesh State Targeted Public Distribution System (Control)
Order, 2018.
2. The writ petition was listed on 07.07.2026 and adjourned at request of learned Assistant Government Pleader for Civil Supplies for getting instructions.
3. Today when the matter is taken up for consideration, Sri A.Vineeth, learned Assistant Government Pleader for Civil Supplies submitted the written instructions of the 3rd respondent-Revenue Divisional Officer along with the proceedings issued by the 3rd respondent vide Rc.No.CS/643/2025, dated 10.07.2026. The relevant portion in the proceedings of the 3rd respondent is as follows:
“In this connection, as per report submitted by the Tahsildar, Gadivemula Mandal, a Show Cause Notice was issued to the dealer calling for an explanation regarding the irregularities noticed during inspection.
In the reference 4th read above, Sri D.Sikhamani, FPS dealer has submitted his explanation within the stipulated time and the explanation submitted by the FPS Dealer was not convinced.
To avoid inconvenience to the card holders, temporary arrangements were made and Smt.B.Jayamma, SHG 2nd leader of Pragathi Podupu Group, Chindukuru village of Gadivemula Mandal was appointed as Temporary FPS dealer for FPS No.1332021 of Chindukuru Village with a condition to terminate at any time without prior notice.
On examination of the entire matter, it is observed that irregularities were noticed in the maintenance of stocks/records. However, the available material does not warrant cancellation of the authorization as the irregularities are simple in nature.
Accordingly, the Tahsildar, Gadivemula Mandal, is directed to restore the operation of Fair Price Shop No.1332021 to Sri D.Sikhamani, FPS dealer of Chindukuru Village of Gadivemula
Mandal and Smt.B.Jayamma, SHG 2nd leader of Pragathi Podupu Group, Chindukuru Vilage, Gadivemula Mandal is hereby terminated.”
4. Given the written instructions of the 3rd respondent coupled with the proceedings dated 10.07.2026, no further adjudication is required in this writ petition.
5. Accordingly, the Writ Petition is Dismissed. No order as to costs.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
