Petitioner has filed this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS”) seeking modification of the bail order dated 02.09.2025 passed in MCRC No.6540 of 2025. 2. Learned counsel for the petitioner submits that vide order dated 02.09.2025, bail application filed by applicant (petitioner herein) has been allowed by this Court directing his release on bail on furnishing a bail bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the Court. However, Digitally signed by PRAVEEN KUMAR SINHA Date: 2026.04.21 11:03:49 +0530 -2- applicant (present petitioner) was not having sufficient means to comply with the bail order of furnishing one surety in the like sum and, therefore, condition of the bail order be modified and direction be issued for release of petitioner (applicant) upon furnishing personal bond in sum of Rs.25,000/- only. 3. Considered the submission of learned for the petitioner herein and applicant in bail application. 4. The bail order of present petitioner (applicant) is dated 02.09.2025. This Criminal Miscellaneous Petition seeking modification of the bail order dated 02.09.2025 is filed on 07.11.2025. 5. From the aforementioned facts, it is appearing that for more than one and half year, petitioner (applicant) could not able to furnish surety as directed by this Court for his release on bail. 6. Considering the facts of the case, I find it appropriate to allow this petition. Accordingly, direction issued for release on bail of applicant (present petitioner) in MCRC No.6540 of 2025 i.e. “upon furnishing a bail bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of Court” is modified and it is directed that “applicant – Ashok Kumar Shaha (present petitioner) shall be released on regular bail upon furnishing personal bond in sum of Rs.25,000/-”. Other conditions mentioned in the bail order dated 02.09.2025 passed in MCRC No.6540 of 2025 shall remain intact. -3- 7. The petition is accordingly allowed. 8.
