IN THE HIGH COURT OF ORISSA AT CUTTACK CRLMP No. 222 of 2026 Durga Padhi …. Petitioner Ms. A. Ray, Advocate -versus- 1. State of Odisha 2. Director General of Police, Cuttack 3. Superintendent of Police, Sambalpur 4. Inspector-in-Charge, Dhanupali P.S., Dhanupali, Sambalpur …. Opposite Parties Mr. Ashok Kumar Apat, Additional Government Advocate CORAM: THE HON’BLE MISS JUSTICE SAVITRI RATHO Order No. ORDER 05.03.2026 01. (Through hybrid mode) 1. This CRLMP has been filed for direction to the Opposite Parties to register the case, arrest the accused persons, give protection to the Petitioner and take appropriate action in pursuance of the FIR of the Petitioner. 2. It appears that on account of some typographical error, certain prayers like registration of the case and to give protection of the Petitioner have been inadvertently typed in the prayer. 3. Be that as it may, it is apparent that Dhanupali P.S. Case No.439 of 2023 has been registered on 20.12.2023 on the written complaint of the Petitioner. The Petitioner, who is the Secretary of the Alumni Association of L.R. Law College, Sambalpur, being aggrieved by the slow pace of the investigation has filed this case. The Petitioner had also approached this Court earlier in CRLMP No.1445 of 2022 pursuant to which, Dhanupali P.S. Case No.439 of 2023 have been registered but this has not been stated in the certificate in this CRLMP. Aggrieved by the slow pace of the investigation, the present Petitioner, Secretary of the Alumni Association of L.R. Law College, Sambalpur along with the President had submitted a representation before the Superintendent of Police, Sambalpur by Speed Post on 08.03.2026. Thereafter they have approached this Court with the above mentioned prayers. 4. Mr. A.K. Apat, learned Additional Government Advocate produces the instruction dated 20.02.2026 of the IIC, Dhanupali P.S. where it has been stated that on perusal of the account statement of the L.R. Law College, Sambalpur, it is found that on 27.02.2024, the Comptroller of Finance, Sambalpur University has transferred/returned the disputed amount of Rs.62,67,000/- to L.R. Law College account through NEFT and the bank account statement received from the Branch Manager, Indian Bank, Sambalpur also reveals that on 27.02.2024, Rs.62,67,000/-has been received from the Comptroller of Finance account through NEFT. It is also stated that investigation in the case is in progress. 5. It appears from perusal of the CRLMP, that one of allegations in the FIR was that on account of transfer of Rs.67,62,000/- in favour of the Sambalpur University, the L.R. Law College was suffering a sizable loss towards the interest over the said amount. 6. Be that as it may, since the amount of Rs.62,67,000/- has already been transferred to the account of the L.R. Law College, Sambalpur, this CRLMP is disposed of with a direction for completion of investigation within a period of three months, if there is no other legal impediment. (Savitri Ratho) Judge RKS
