2. By means of this writ petition, following reliefs have been sought by petitioner:
“A. To issue a writ, order or direction in the nature of certiorari quashing the entire proceeding of the case No. 114/16.17 titled Madan Mohan Vs. Saraduram pending before respondent No. 3 i.e. Court of Tehsildar Tehsil Kotdwar, Garhwal, initiated by respondent No. 3 pursuant to the application moved by respondent No. 5 regarding land in question.
B. To issue a writ order or direction restraining the respondents from interfering in the peaceful possession of the petitioners over the land in question.”
3. Learned State Counsel submits that writ petition is premature, as whatever petitioner has to say can be said by him before the Court dealing with mutation proceeding.
4. She submits that since the earlier order was passed without hearing respondent No. 5, who claims to be representative of Arya Samaj and also claims that the land belongs to Arya Samaj, therefore there is nothing
2026:UHC:4532 wrong if his application for seeking restoration of mutation proceeding was allowed.
5. This Court finds substance in the contention raised by State Counsel.
6. Since no order has been passed to the prejudice of the petitioner, therefore this Court is not inclined to interfere in the matter.
7. The writ petition is, however, disposed of with liberty to petitioner to raise all
contentions before the Court concerned.
