Nanda, learned counsel for the petitioner and learned A.C. to Sr.S.C.-I. In this writ application, the petitioner has prayed for a direction upon the respondent no.5 to provide for proper security in the form of Arms Guard to the petitioner and his family members as he is a victim of the extortion threats made by anti-social elements on repeated basis. The petitioner has further prayed for a direction upon the Deputy Commissioner, Dhanbad to grant him Arms licence for which an application has already been made by him. The further prayer of the petitioner is for an expeditious conclusion of investigation of Govindpur P.S. Case No.254 of 2024 which has been instituted by him. Submission has been advanced by the learned counsel for the petitioner that the petitioner is a businessman who manufactures spare parts of crusher machines and who has received international threats as well for which Govindpur P.S. Case No.254 of 2024 was instituted. It has been submitted that despite institution of the First Information Report, there have been certain occasions when firing was made in the house of the petitioner which resulted to posting of some Arms Guard for a temporary period, but subsequent thereto the Arms 2026:JHHC:10341 -2- Guards have been removed. Learned counsel submits that the petitioner has applied for an Arms licence which is at present pending before the Deputy Commissioner, Dhanbad (respondent no.4). Learned counsel therefore submits that neither the investigation into Govindpur P.S. Case No.254 of 2024 is progressing nor efforts have been taken by the respondent no.4 as well as the respondent no.5 for giving Police protection to the petitioner and according sanction for the arms licence. Learned A.C. to Sr.S.C.I, based on the averments made in the counter affidavit, has submitted that the patrolling parties are regularly visiting the locality of the petitioner to ensure his safety. It has further been submitted that a recommendation has been made by the respondent no.5 to the respondent no.4 for grant of arms licence and the matter is now pending before the respondent no.4. It appears from the counter affidavit that there is a threat perception in the life of the petitioner and to ensure the protection of the life and liberty of the petitioner and his family members, the respondent no.5 might consider taking effective measures which may include patrolling of police party as well as providing of Arms Guard to the petitioner. It also appears that arms licence as applied for by the petitioner is pending before the respondent no.4 and in such circumstances the respondent no.4 is directed to consider the recommendation of the respondent no.5 and act upon the application for arms licence submitted by the petitioner expeditiously.
