The applicant has preferred this first bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act, 2023 for grant of regular bail as he is arrested in connection with Crime No. 709/2024, registered at Police Station – Vidhansabha Raipur, District- Raipur (C.G.) for offence punishable under Sections 103(1), 109, 190, 191(3) of BNS. 2. As per the prosecution case, complainant lodged a report to the concerned police station alleging therein that on the date of incident, the unknown persons have assaulted Rohit Sagar, SOURABH PATEL Digitally signed by SOURABH PATEL Date: 2026.04.22 15:24:04 +0530 2 Ram Sona and Mohit Ram Jangde by means of knife due to the said assault Rohit Sagar died during treatment and Ram Sona and Mohit Ram Jangde sustained grievous injuries. It is alleged against the applicant that on the date of offence, i.e. 18.11.2024, the applicant, along with other co-accused persons, also assaulted the deceased and the injured persons. Based on this, offence has been registered against the present applicant along with other co-accused persons. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated. He further submits that the FIR was lodged against the unknown persons, and nothing has been seized from the applicant, with no overact attributed to him. He next submits that the two injured persons namely Mohit Ram Rajgod (PW-2) and Ram Sona (PW-8), who are also eyewitnesses, have been examined and haven't stated anything against the applicant. The applicant is in jail since 13.01.2025 and till date out of a total 42 witnesses, only 09 have been examined and there is no immediate possibility of disposal of case, therefore, the applicant may be enlarged on bail. 4. Per contra, learned State Counsel opposes the bail application and submits that the applicant was also involved in the crime in question and there is one criminal antecedent against him. The bail applications of other co-accused persons, namely Gitesh Yadav and Nikil @ Ashu, have been rejected by this Court. He next submits that the main eye witnesses, Deepak and Sahdev 3 have not been examined till date, therefore, at this stage, the applicant should not be released on bail. 5. Having considered the submissions made by learned counsel for the parties, the overall facts and circumstances of the case and the fact that the eyewitnesses Sahdev and Deepak have not been examined till date, at this stage, I am not inclined to release the applicant on regular bail. Accordingly, his bail application is rejected. 6. However, looking to the custody period of the applicant, the trial Court is directed to expedite the trial as early as possible. 7.
