KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.04.22 19:38:19 +0530 2 (Single Bench) Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 22/04/2026 1. None appears for the appellant in two rounds. 2. The appellant/claimant has preferred this Appeal under Section 173 of the Motor Vehicles Act, 1988 (for short ‘the Act, 1988’) calling in question the legality, validity and correctness of the award dated 20.09.2019 passed by the 1st Additional Motor Accident Claims Tribunal, Mahasamund (for short ‘the Claims Tribunal’) in Claim Case No.H-213/2016 by which liability to pay compensation of Rs.30,000/- has been fastened on the Insurance Company. In the present Appeal, the appellant/ claimant has prayed for enhancement of the compensation amount. 3. Considering the fact that in the accident occurred on 6.12.2015, the appellant/claimant had suffered serious injuries on his head, right leg & waist and femur bone of right leg was fractured because of which steel rod was inserted, and towards medical expenses Rs.4,75,000/- was incurred, which was paid by the Appellant’s department and only a meagre amount of Rs.30,000/- has been awarded by the Claims Tribunal, this Court is of the opinion that ends of justice would be served if Rs.70,000/- more along with interest @ 7% is awarded to the appellant/claimant. Ordered accordingly. The Insurance Company is directed to pay the enhanced amount of compensation within a period of three months from the date of 3 receipt of a copy of this order. The additional amount of compensation shall carry interest @ 7% per annum from the date of filing of claim application before the Tribunal till its realization. Rest of the conditions of the impugned award shall remain intact. 4. With the aforesaid modifications, the Appeal is disposed of. 5. Let a copy of the order be sent to the appellant/claimant forthwith, as he remained unrepresented before this Court. Sd/- (Sanjay K. Agrawal) Judge Barve
