THIS W.P. IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT, DIRECTING THE RESPONDENTS TO CONSIDER THE REPRESENTATIONS SUBMITTED BY THE PETITIONER TO REGULARIZE AND GRANT THE FULL 30X40 FEET SITE IN SY.NO.40 TO THE PETITIONER. CORAM: HON'BLE MR. JUSTICE R DEVDAS

The grievance of petitioner is that earlier, considering the application filed by the petitioner, a site measuring 30 x 40 feet was granted in favour of the petitioner. Annexure-B. It is now sought to be contented by the petitioner that what was earlier allotted to the petitioner was 30 x 40 feet and now only 20 x 30 feet have been granted and therefore, the additional extent of land should be made good. In that regard representations have been given by the petitioner.
The prayer in this petition is to issue a writ of mandamus directing the respondent authorities to consider the representation given by the petitioner and re-grant 30x40 feet site instead of 20x30 feet site. 3. In the considered opinion of this Court, such a prayer cannot be granted. The sale deed was executed in favour of the petitioner on 31.05.2022 and the petitioner has accepted the said grant. Such being the position, at this point of time the same cannot be cancelled with a direction to re-grant a site measuring 30 x 40 feet. If the petitioner was aggrieved of the grant of 20 x 30 feet, he should have declined to accept the grant. However, now since admittedly a sale deed has been registered in favour
