1. This misc. bail application has been filed by the petitioner Ravi S/o Haridwar Singh, who was arrested by the police on 16.02.2026 in connection with the FIR bearing No.387/2021 dated 23.10.2021 registered at Police Station Chiksana, District Bharatpur for the offences punishable under Sections 420, 120B IPC and Section 4(b) of the Rajasthan Public Exam (Use of Unfair Means) Act, 1992.

Learned counsel submitted that the bail application filed by the petitioner was rejected by the Additional Session Judge No.4, Bharatpur vide order dated 24.02.2026, thereafter, the petitioner has preferred this bail application under Section 483 of B.N.S.S.

Learned counsel submitted that the police after conducting the investigation has filed the charge-sheet. Learned counsel submitted that all the persons participated in the alleged exam, in
[2026:RJ-JP:11497] (2 of 3) [CRLMB-3696/2026] which, it has been stated that the petitioner tried to leak the question paper, have already been enlarged on bail by the coordinate Bench of this Court under Section 483 of B.N.S.S.
Learned counsel further submitted that there are no criminal antecedents of any nature and further contents of the charge- sheet itself failed to disclose any specific role.

Learned counsel submitted that no recovery is required to be made and the trial will take sufficiently long time. Learned counsel further submitted that the other co-accused namely Shubham, Arun, Manish, Rajesh, Trilok, Pradeep, Pintu, Indrajeet, Vishnu and Jitendra Singh have already been enlarged on bail by the co- ordinate Bench of this Court. In view thereof, learned counsel prayed that the petitioner be enlarged on bail.
5. Learned Public Prosecutor strongly opposed the bail application, however, could not dispute the fact that the other co- accused have already been enlarged on bail by the co-ordinate Bench of this Court.

This Court, considered the fact that the other co-accused who participated in the recruitment process have already been enlarged on bail, charge-sheet has already been filed, trial will take sufficiently long time, the nature of allegations, the petitioner was arrested after a delay of almost 3-4 years. Looking to the overall fact that in the State of Rajasthan in last 3-4 years consistently papers were leaked by certain persons by forming illegal groups and the petitioner is not involved in any other case of similar nature, this Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-petitioner Ravi S/o Haridwar Singh on bail.

Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-petitioner Ravi S/o Haridwar Singh shall be released on bail, provided he executes a personal bond in a sum of Rs.1,00,000/-with two sound and solvent sureties of Rs.50,000/- to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The petitioner is further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case.
8. It is further directed that in case, the petitioner is found to be involved in any case within two years from the date of passing of this order, learned Public prosecutor shall file an application for cancellation of the bail.
