Learned counsel for the petitioner submits that delay occurred for removing the objections raised by the Registry due to voluminous papers appended alongwith the writ petition. Learned counsel further submits that additionally on account of his being not in country for months together, the objections could not be rectified in time. Taking note of the pleadings, submission made by learned counsel and in the interest of justice, delay in refiling the petition is condoned subject to cost of ₹2000/- to 1Whether reporters of print and electronic media may be allowed to see the order? Yes. 2 be deposited in "Chief Justice Disaster Relief Fund 2025" within two weeks. Application to stand disposed of. CWP No.3107 of 2026 Issue notice. Notice confined to respondents No. 1 to 6, which is waived by Mr. L.N. Sharma, learned Additional Advocate General. In view of the grievance of the petitioner urged and the order being passed hereinafter, notice of this petition is not required to be issued to the remaining respondents. Reply is also not required to be called for from appearing respondents. Matter has accordingly been heard at this stage. This writ petition has been filed for grant of following substantive reliefs:- “(a) To issue a writ of mandamus, appropriate writ, order or direction in nature thereof, directing the respondent-Department to register F.I.R. in the aforesaid matter against all the named individuals and conduct investigation/ inquiry and bring the issue to the logical end in accordance with the law; (b) To issue an appropriate writ, order or direction in nature thereof to give full justice to the petitioner in the circumstances of the case and may pass such further writ, order or orders as this Hon’ble Court may deem fit, proper, just and expedient in the circumstances of the case.” 2. Learned counsel for the petitioner submits that petitioner has issued a legal notice to respondents No. 1 to 3 6 on 04.06.2023 (Annexure P-1) for the redressal of his grievances raised in this writ petition, however, the same not been considered by the respondents. The only response the petitioner received in furtherance to aforesaid notice was on 13.07.2023 from Additional Deputy Commissioner, District Sirmour wherein the Sub-Divisional Magistrate, Paonta Sahib, District Sirmour was directed to examine the matter for redressing petitioner’s grievances. Attention was also invited to office letter dated 14.07.2023 from respondent No.3- Director General of Police, directing respondent No.5- Superintendent of Police, District Sirmour for further necessary action in the notice sent by the petitioner. 3. Learned counsel submits that the petitioner has not been intimated about any further action taken by the authorities for redressing his grievances highlighted in the notice dated 04.06.2023. Learned counsel further submits that petitioner would be satisfied in case Competent Authorities are directed to take appropriate call in accordance with law for redressing petitioner’s grievances raised in the aforesaid notice and the same be treated as petitioner’s representation. Learned Additional Advocate General is not averse to this prayer. 4 4. Having regard to above submissions, but without examining the merits of the matter, this writ petition is disposed of by directing respondent/Competent Authority to consider and examine the contents of notice dated 04.06.2023 (Annexure P-1) and take appropriate action as deemed fit in accordance with law.
