By way of this petition, the petitioner has sought the following relief(s):- “10.1 That, the Hon'ble Court be pleased order dated 31/10/2020 passed by the Registrar, Registrar, Indira Gandhi Krishi Vishwavidyalay so far it relates to the promotion of the juniors of the petitioner respondent no. 4 Shri Praveen Kumar SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2026.04.20 11:26:51 +0530 2 Dhruv and Respondent no.5 Shri Komal Prasad Gawfe as Assistant Grade-I. 10.2 That, the Hon'ble Court be pleased to direct the respondent petitioner from authorities to promote the retrospective effect from 31/10/2020 along with consequential effect when the juniors of the petitioner respondent no. 4 Shri Praveen Kumar Dhruv and Respondent no.5 Shri Komal Prasad Gawre were promoted as Assistant Grade -I. 10.3 That, any other relief which this Hon'ble court deems fit in the present facts and circumstances of the case may kindly be granted.” 2. Ms. Pandey would submit that the petitioner is posted on the post of Assistant Grade II in Krishi Vigyan Kendra, Rajnandgaon as she was appointed on 19.02.2015 as member of Scheduled Tribe category. She would contend that the petitioner was eligible for promotion to the post of Assistant Grade I along with her juniors on 31.10.2020, but her name was not considered in absence of ACR of year 2018-19. She would contend that subsequently, the department rectified their mistake and issued an order of promotion in favour of the petitioner on 29.12.2022. Ms. Pandey would submit that the petitioner is entitled for all benefits attached to the promotional post from 31.10.2020 when her juniors were promoted to the post of Assistant Grade-I. 3. On the other hand, Ms. Priyanka Rai Mishra, Advocate would oppose the submissions made by Ms. Pandey. She would submit that pursuant to order passed by this Court an affidavit was filed on 25.01.2022 wherein this fact is not disputed that adverse entries made in the ACR of the petitioner for the year 2018-19 were not communicated, and therefore, her name was not considered for promotion to the post of Assistant Grade-I in the DPC, which was convened on 13.10.2020. 3 4. Taking into consideration the fact that the petitioner has already been promoted to the post of Assistant Grade-I vide order dated 29.12.2022 and immediately thereafter, she resumed her services on the said post, therefore, in opinion of this Court, the petitioner would be entitled for notional benefits including seniority etc. from 31.10.2020. The petitioner would be at liberty to make a representation before respondent No. 1 within a period of 15 days from today, and in turn, the authority concerned is directed to take appropriate decision in light of the observations made herein-above within further period of 15 days. 5.
