This bail application has been filed on behalf of the accused- petitioner under Section 483 of B.N.S.S. in connection with FIR No. 40/2019 registered at Police Station Basai Dang, District Dholpur for the offence(s) under Section(s) 332, 353, 333, 307, 143, 149, 506, 379 IPC, under Section 3 of Prevention of Damage to Public Property Act, 1984, under Sections 41, 42 of Rajasthan Forest Act, 1953 and under Sections 3, 25 of The Arms Act, 1959. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has been falsely implicated in this case and the accused-petitioner is behind the bars since 12.02.2026. He further submits that the accused-petitioner is already enlarged on bail in other criminal cases instituted against him. He further submits that similar situated co-accused persons namely Naresh @ Badshah and Banti @ Amresh have already been enlarged on bail [2026:RJ-JP:12996] (2 of 3) [CRLMB-4525/2026] by the Co-ordinate Bench of this Court vide order dated 30.06.2022 in S.B. Criminal Miscellaneous Bail Application No. 9085/2022 and 19.07.2022 in S.B. Criminal Miscellaneous Bail Application No. 10346/2022 respectively. He further submits that the injuries sustained by the injured are neither dangerous to life nor inflicted on vital parts of the body and conclusion of trial will take its own time, so no fruitful purpose would be served by keeping the accused-petitioner in custody and therefore, prays that the petitioner may be granted the benefit of bail under Section 483 of BNSS. 3. Per contra, learned Public Prosecutor vehemently opposes the submissions made by learned counsel for the petitioner hereinabove and submits that there are criminal antecedents against the accused-petitioner. 4. Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced by learned counsel for the petitioner that the accused-petitioner is behind the bars since 12.02.2026; co-accused persons have already been enlarged on bail; the injuries sustained by the injured are neither dangerous to life nor inflicted on vital parts of the body and trial will take its own time. Hence, this Court without expressing any opinion on the merits/demerits of the case deems it just and proper to enlarge the accused-petitioner on bail. 5. Therefore, this bail application under Section 483 BNSS is accordingly, allowed and the accused-petitioner Santosh @ Sodhi S/o Bhagwan Singh is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the [2026:RJ-JP:12996] (3 of 3) [CRLMB-4525/2026] satisfaction of the trial Court, with the stipulation that he shall appear before that Court and any court to which the matter is transferred on all subsequent dates of hearing and as and when called upon to do so. 6. It is made clear that the accused-petitioner shall not be involved in any other offence(s) during currency of the bail and he shall mark his presence on 1st and 15th day of every month in the concerned police station. 7. In case of any breach of the aforementioned conditions, the learned Public Prosecutor shall be free to to move the application against the accused-petitioner for cancellation of the bail before the concerned Court. 8.
