1. Heard learned Counsel for the Petitioner and learned A.G.P. for the Respondent-State.
2. For the period from 1st April, 2019 to 31st March, 2020, the issue involved in the present Petition is squarely covered by the decision of this Court in Marathon Electric India Private Limited Vs. Union of India & Ors. [Writ Petition No.15242 of 2025] dated 16th April, 2026, for the same reasons we quash and set aside the impugned Order dated 17th October, 2023 (Exhibit-A). 3. The proceedings stand remanded to Respondent No.3 for de novo consideration to decide the refund claim of the Petitioner and for a fresh order to be passed in accordance with law and after hearing the parties. The Appellate Authority shall complete the determination within a period of three months from today.
4. All contentions of the parties are expressly kept open.
5. In view of above, Writ Petition No.3893 of 2026 stands
disposed of.
